Refund policy

ALL SALES ARE FINAL.

Cherié sells made-to-order, custom-color silicone accessories. We do not accept returns, exchanges, refunds, or store credit for change of mind, fit dissatisfaction, color preference, comfort issues, or any reason whatsoever, except as expressly required by the limited circumstances and consumer-protection laws set out below.

BY PLACING AN ORDER, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT (i) YOUR PURCHASE IS A FINAL SALE, (ii) YOU HAVE READ AND UNDERSTAND THE PRODUCT COMPATIBILITY GUIDANCE PUBLISHED ON OUR HOMEPAGE, FAQ, AND PRODUCT DESCRIPTIONS BEFORE ORDERING, AND (iii) YOU ACCEPT THE RISKS AND LIMITATIONS DESCRIBED IN THIS POLICY.


PRODUCT FIT AND COMPATIBILITY

The Cherié Cover is designed to fit most adult sunglasses with classic frame edges (wayfarers, aviators, cat-eyes, round wire frames, slim acetates). It is NOT designed to fit, and we will NOT accept fit-related claims for, the following frame types:

- Rimless or frameless lenses
- Oversized chunky frames
- Wraparound sport-style frames
- Children's, prescription-only, or specialty optical frames not commonly described as "sunglasses"
- Frames with non-standard temple geometry, integrated electronics, or aftermarket modifications

You are solely responsible for confirming compatibility with your specific sunglasses before ordering. Fit-related complaints, including but not limited to "doesn't grip my pair," "magnets don't hold," or "doesn't cover my lenses fully," are not eligible for refund, replacement, return, or store credit.


COLOR, MATERIAL, AND APPEARANCE VARIANCES

Silicone is a natural, manufactured material. Minor variances in color saturation, surface texture, magnet placement (within 2mm tolerance), gloss level, scent, and overall appearance are inherent to the product and are NOT defects. Photographs and renderings on our website are illustrative; final products may differ slightly in hue, tone, or finish due to lighting, batch variation, monitor calibration, and manufacturing tolerances. Such variances are not grounds for any claim, refund, or replacement.


ALLERGY AND SKIN CONTACT DISCLAIMER

Cherié Covers are made from medical-grade silicone. Although uncommon, certain individuals may have sensitivities to silicone, dyes, or surface treatments. We are not responsible for allergic reactions, skin irritation, or any health consequences arising from product use. If you have a known silicone or rubber allergy, do not purchase. By ordering, you confirm that you have no known medical condition that would make use of a silicone accessory inadvisable, and you assume all risk of allergic reaction.


DAMAGED, DEFECTIVE, OR INCORRECT ITEMS (LIMITED REMEDY)

If your order arrives with a verifiable manufacturing defect, physical damage caused in transit, or contains the wrong color from what you ordered, you may request a one-time replacement subject to ALL of the following:

1. You contact derin@deepseamedia.ca within seven (7) calendar days of the date the carrier marks the package as delivered. Claims received after this period will be denied without exception.

2. You provide ALL of the following in your initial email: (a) order number, (b) at least three (3) clear, well-lit color photographs of the issue from different angles, (c) a photograph of the shipping packaging if the issue is transit damage, (d) a written description of the defect or error.

3. We verify, at our sole discretion, that the issue constitutes a manufacturing defect, transit damage, or fulfillment error. Cosmetic variances within manufacturing tolerance, normal wear, user damage, and fit-related complaints are excluded.

4. You agree, at our request, to return or destroy the defective item before a replacement is shipped.

If approved, we will ship a replacement in the same color and quantity at no additional cost. We do not provide cash refunds, store credit, or alternative-color substitutions in lieu of a verified replacement. Our total liability under this clause is limited to one (1) replacement per affected unit. If a replacement is unavailable due to discontinuation or stock limitations, we may, at our sole discretion, refund the original purchase price of the affected unit.


CANCELLATION OF ORDERS

Orders are processed for fulfillment within one (1) to three (3) business days. We may, at our sole discretion, accept cancellation requests received before the order is handed to the carrier. Once a tracking number has been generated, the order is irrevocable and cannot be canceled, modified, or refunded. We charge no cancellation fee for accepted cancellations.

We reserve the right to cancel any order, in whole or in part, for any reason including but not limited to (a) suspected fraud, (b) sanctions or export-control screening hits, (c) inventory or pricing errors, (d) failed payment authorization, (e) shipping addresses we deem high-risk, or (f) any breach of these terms. If we cancel an order, we will refund the purchase amount to the original payment method.


LOST, STOLEN, OR UNDELIVERED PACKAGES

Title and risk of loss for all products pass to you at the moment we hand the package to the carrier. We are not insurers of your shipment.

If your tracking shows the package as delivered but you have not received it:

1. Check with neighbors, mailroom, building manager, and local postal facility.
2. Wait three (3) business days — carriers frequently mark packages "delivered" prematurely.
3. If still missing, contact derin@deepseamedia.ca with your order number. We will open a claim with the carrier on your behalf as a courtesy. Resolution depends entirely on the carrier's investigation.

If the carrier confirms delivery, the package is presumed delivered and we are not liable for replacement, refund, or any other remedy. We reserve the right to require a signed affidavit of non-receipt and a police report for losses we choose, in our sole discretion, to investigate further.


REFUSED, RETURNED, OR UNCLAIMED SHIPMENTS

Packages refused at delivery, returned due to incorrect or incomplete address, unclaimed at customs, blocked by customs, abandoned at a delivery facility, or returned to sender for any reason are NOT eligible for refund. We may, at our sole discretion, offer to resend the order at the customer's expense (which may include re-shipping fees, customs reprocessing fees, and our handling charges). If we elect not to resend, no refund will be issued; the customer assumes the loss.


CUSTOMS, DUTIES, AND IMPORT TAXES (INTERNATIONAL ORDERS)

Customs duties, VAT, GST, import taxes, and brokerage fees are determined by the destination country and are NOT included in our prices. The customer is solely responsible for these fees. If you refuse to pay them, your package will likely be returned, abandoned, or destroyed by customs; in any of these scenarios you forfeit the order without refund.

We are not responsible for customs delays, seizures, inspections, or destruction of products. Some destination countries restrict or prohibit silicone accessories, magnetic products, or specific colorants; you are responsible for verifying that your country allows import of the product before ordering.


CHARGEBACKS, FRAUDULENT CLAIMS, AND ABUSE

Filing a chargeback or payment dispute without first contacting us and giving us a reasonable opportunity to resolve the issue (a minimum of ten (10) business days from your initial written communication to derin@deepseamedia.ca) constitutes a material breach of these terms. We will contest unfounded chargebacks vigorously with all available transactional evidence (delivery confirmations, IP logs, billing-shipping match, photographic dispatch records).

If we determine, in our sole discretion, that a customer has filed a fraudulent damage claim, falsified non-receipt, manipulated photographs, used multiple accounts to abuse our replacement policy, or otherwise acted in bad faith, we reserve the right to (a) deny the claim, (b) ban the customer from future orders, (c) report fraud to payment processors, law enforcement, and consumer credit agencies, and (d) seek recovery of any costs incurred including legal fees.

Customers found to have filed fraudulent claims are responsible for the original purchase price plus a USD $50 administrative-investigation fee.


STATUTORY RIGHTS BY JURISDICTION

The provisions of this policy do not exclude or limit any statutory consumer rights that cannot be lawfully waived in your jurisdiction. The following sections describe specific rights that may apply to you depending on your country of residence:

European Union — 14-Day Cooling-Off Period (Directive 2011/83/EU). EU-resident consumers may cancel their order within 14 calendar days of receiving the goods, for any reason, by emailing derin@deepseamedia.ca with their order number and a written cancellation request. The customer must return the unused, undamaged item in original packaging at their own expense within 14 days of cancellation. Once we receive and inspect the returned item, we will refund the original purchase price (excluding outbound shipping) within 10 business days. EU rights do not apply to (i) clearly personalized custom orders, (ii) items unsealed by the consumer if hygiene is a factor, or (iii) any other category exempted under Article 16 of the Directive.

United Kingdom — Consumer Contracts Regulations 2013. UK-resident consumers have substantially the same 14-day cooling-off rights as EU consumers under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Same conditions apply.

Australia — Australian Consumer Law. Nothing in this policy excludes the consumer guarantees under the Australian Consumer Law, including the right to a remedy if goods are not of acceptable quality, do not match their description, or are not fit for a disclosed purpose. For minor failures we may, at our discretion, choose between repair, replacement, or refund. For major failures the consumer may choose. Customers in Australia should contact derin@deepseamedia.ca with their order number and ACL-specific claim.

Canada — Provincial consumer protection statutes apply where the consumer resides in a Canadian province with mandatory consumer protections that cannot be waived. Such statutory rights are preserved.

United States — California, New York, and other state consumer protection statutes apply where mandated. Customers in California also have rights under the California Consumer Privacy Act regarding personal data, addressed in our Privacy Policy.

In all cases, the customer must initiate any statutory claim by contacting derin@deepseamedia.ca with their order number and a clear description of the alleged failure within the time limits specified by applicable law. The remedies set out in this policy are in addition to, not in substitution for, statutory rights that cannot be lawfully waived.


REFUNDS (WHEN APPROVED)

When a refund is approved under any clause of this policy, it will be issued to the original payment method only. We do not issue refunds in cash, check, gift card, store credit, or any alternative form unless required by law. Refunds typically appear within 10 business days of approval; your bank or card issuer may take additional time to post the credit. If more than 15 business days have passed since written approval and you have not received the refund, contact derin@deepseamedia.ca.

Refunds are issued in the original currency of purchase. Currency-conversion losses, foreign-transaction fees, and exchange-rate fluctuations are not reimbursable.


LIMITATION OF CLAIMS

Any claim arising out of or related to your purchase must be brought within one (1) year of the order date, or it is permanently barred. This limitation applies to the maximum extent permitted by law.


LIMITATION OF LIABILITY

Our total liability for any claim arising from or related to your order, regardless of the form of action, is limited to the amount you actually paid for the affected unit, exclusive of taxes and shipping. This limitation applies to the maximum extent permitted by applicable law and does not limit liability for fraud, willful misconduct, death, or personal injury caused by negligence to the extent such limitations are prohibited by law.


GOVERNING LAW

This policy is governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-laws principles. Disputes are subject to the dispute-resolution provisions of our Terms of Service.
